Hello, My Labor got certified with PD Oct 2003 under EB2.
I have to file for I-140. Where can I check the status whether it is current or lagging back ? Also is there a Premium 140 for EB2 started or not yet? Since I cannot file for I-485 till it becomes available and current to my PD, does it make sense to file for Premium 140 or should I file regularly?
What are the steps for I-140 and any urls where I can see the status..?

I am nearing the five years on my H1B. My company (A) had it extended with my I-i40 approval. I want to know at this point is it okay to transfer h1B visa to another company (B)? I was told i can only get 9 month extensions with the transfer is that true? Also what if my company (A) cancels my GC process after transferring to company (B), do i have to go through the entire GC process again once I transfer to company (B)? I was told i only have to re apply the I-140 with the priority date given on the previous I-140?

Hello everyone, My husband whose PD is Oct 2006 EB2 got his email today...
On March 24, 2010 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service at 1-800-375-5283.
I have two questions...
1) How is it possible to get GC out of turn.........?
2) We moved to a new house n updated the address, but for some reason it was not correct. The system(also the customer service) wont let me update till 45 days have passed. Now the document will come to the wrong address? What do i do?

Congresswoman Zoe Logfren & & senator John Cornyn are supporters of legal immigration, they have always come forward to help the legal immigrant community. I guess it is high time people from California & Texas write & call to their offices and complaint about USCIS/DOS action of not releazing and statistics on I-485 applications pending invarious categories. We are blind folded by these Visa bulletins with no idea of what there for EB-3, EB-2 India, China etc. we don't know how many people are ahead of us what to do next. All this will resolve it USCIS/DOS tells us how many applications they have pending from which country and which category....For that we need to call these lawmakers..

My Wife had her COS from H4-H1, and I filed my I-485 in July with my wife as secondary applicant and already got our EAD,AP. We are planning to Visit India this month and my wife wants to use her AP while travelling back to US.
1. Is it advisable or are there any issues with using AP.
2. Can she use AP that she received as a secondary applicant and continue to work on H1B with her current employer
3. In Case her Status changes to EAD, can we reinstate her H1B at any point in time without counted against H1B Cap.
Pl Advise.

Hi,
perm filed on 03/13/2010. Today my employer HR emailed me that my case was selected for audit. They didn't give me any letter confirming that my case is really selected for audit, on the other hand instructed me to sign ETA form 9089 and send back the original form. ETA form has OMB Approval : 1205-0451. Does that mean that my case has been approved and my employer is lying to me? I read somewhere case filed electronically are needed to be signed and original form be sent back for final processing.
Please advice.

I applied for the I-140 and I-485 at the same time last October 9th 2009. I was requested an RFE in February of 2010 which they received back in March before the deadline. The RFE was looking for some basic info. I am still awaiting a response to the RFE or approval of the I-140. My job is currently going through tough times and there are rumors I will be laid of on April 30th. My question is that after April 9th(180 days after i filled I-140 and I-485) can i move jobs to a similar role before my I-140 is approved and if so what do i need to do.

My H1-B visa ended on December 31, 2009. I applied for a change of status to F1 visa on December 21st, 2009 towards the Spring 2010 (Jan 2010) semester. I received an RFE stating that I need to send a new I-20 for a valid future semester.
Assuming this new I-20 is for Summer 2010 (May 2010), my question is as follows - If my change of status to F1 gets approved and my semester starts 2 months later, am I allowed to legally stay in the country?

IV website service provider has informed that they will be installing new hardware on the core switches that are used by IV servers. As such there is a scheduled down time of up to an hour which will occur on October 24, 2008, sometime between 12 AM CST and 6 AM CST.

I would like to invite my brother to US for a 2 month road trip I am planning in April.
I finished my employment in Jan and currently on 6 months B2 visa. I got my NZ residency approved and I will be leaving US in June at the end of road trip. I have been living in US for past 10 years (3 years on F1 and 6.5 years on H1B). I am 32 unmarried/male/Indian from Hyderabad.
My brother is 33 and is married with a 3 year old daughter. He manages my dads businesses (rental properties, finance, farm etc.). I am pretty sure he has some properties on his name.
I would like to know what are his chances of getting visa approved.
What do I need to provide him as support and what does he need to provide as support documentation ?? What does US consulate look for support typically and to what extent ?
I would really appreciate if anyone can give some advice especially someone who were successfully able to get a US visitor visa to their brother.
